At LVW Law, we are committed to providing our federal employee clients with a clear and transparent understanding of the costs and fees associated with legal representation. Here you will find detailed insights on what you can expect from our law firm when seeking representation for federal employment and workplace rights cases.
Overview of Our Process and Fee Structure
Our goal is to ensure you have a clear picture of the expenses associated with our services, as well as payment options and the possible reimbursement of legal fees. Here is what you can expect:
- Free Intake Session: To begin, we provide a complimentary initial phone consultation to collect essential details about your case and assess how we can best support you. This session helps us understand your situation and determine the next steps without any financial commitment on your part.
- Paid Consultation with an Attorney: After the initial intake, we offer an in-depth consultation with one an experienced MSPB and federal employment attorney for a flat fee of $300. During your consultation we will thoroughly examine the specific details of your case with you and explore potential legal strategies. Your attorney will answer any questions you may have, and outline a clear roadmap for moving forward.
- Initial Retainer Amount: After your consultation, we will send you an initial retainer to begin legal work on your case. Our standard retainer is $5,000-$7,500 depending on the complexity and specific needs of your situation. A retainer is not normally the full fee, but rather is a deposit to secure services against fees that accrue. In the event that the work ends up costing less than the retainer, you will be refunded the difference.
- Recovery of Legal Fees: In some circumstances, if you prevail in your case your legal fees may be reimbursed by the federal government. Please see our Recovery of Attorney Fees section below.
At LVW Law, our transparent fee structure helps you navigate your case with confidence while delivering expert legal support that meets your specific needs. If you work for the federal government and have an employment-related legal issue, contact us today and let our law firm fight for you.
Financing Plans and Options
We recognize that legal fees can be a concern, and to that end we have partnered with a third-party financing company which can provide flexible payment options for clients who qualify. Our financing partner, Pay Later (formerly known as ClientCredit), is a legal fee financing solution powered by Affirm and exclusively available through LawPay. This option allows you to access the legal support you need without the burden of upfront costs.
Recovery of Attorney Fees
In some cases, you may be eligible for reimbursement of attorney fees from the federal government, and our attorneys will do everything they can to have your fees reimbursed if you win your case. While fee reimbursement is not guaranteed, it may be possible in specific types of cases, particularly those involving appeals or federal employment disputes where the law provides for such compensation.
- Possible Reimbursement: The federal government may be required to reimburse your legal costs, including attorney fees and filing fees, incurred during MSPB appeals or EEO complaints, if you prevail in your appeal. Eligibility for reimbursement depends on the specific facts and legal arguments of your case. During your initial consultation, your attorney will discuss the possibility of having your legal fees reimbursed.
- Common Situations for Reimbursement: Fee reimbursement is more likely in cases involving whistleblower reprisal, discrimination, or other prohibited personnel practices, especially when the employee’s protected activity was a contributing factor in the agency’s action. Additionally, USERRA lawyer costs may be recoverable if you prevail in a case under the Uniformed Services Employment and Reemployment Rights Act.
- Filing for Recovery: When appropriate, our law firm will do everything they can to help you seek reimbursement of attorney fees and all other eligible expenses promptly and effectively from the federal government.
