HOW TO WRITE AN MSPB APPEAL

If you have experienced a suspension of at least 15 days, a demotion, or termination that was undeserved or discriminatory, you could be able to submit an appeal with the Merit System Protection Board (MSPB).

How to Submit an Appeal With the MSPB

You’ll need to submit your appeal with the MSPB’s area or field office in the region where your duty station was located, but if the appeal recounts a final decision of the OPM about retirement benefits or a suitability decision, you’ll have to submit to the regional or field office that presides over the place you live.

For most Federal employees, you have to enter your appeal with the MSPB inside 30 days of the effective date of the decision, or 30 days after the date you got the agency’s decision, whichever is later.

That being said, please note that certain types of Federal employees don’t have MSPB rights, or must follow different timelines. Many of these differences relate to USPS and Veterans Affairs employees.
